SEX-STARVED WIFE DIVORCES HUSBAND - Swaziland


SITEKI – A woman has divorced her husband on the grounds that he deserted their matrimonial homestead and further denied her conjugal rights.

In her particulars of claim, filed at the Siteki Magistrates Court, Sizakele Bhembe (nee Mkhabela), of Mhlume teacher’s quarters, stated that she married Ernest Boy Bhembe, through civil rites and in community of property, on June 28, 1995.
She informed the court that three children, aged 16, 15 and two, were born from the marriage.

She stated, in her court papers, that while the marriage still subsisted, her husband deserted their matrimonial homestead and went  to stay at his parental homestead.

Desertion

“The desertion by the defendant left the plaintiff alone with minor children and in the process the plaintiff having to fend for the minor children,” said the wife.
She further told court that, by vacating their matrimonial homestead, her husband denied her conjugal rights, which is a requirement for married people.
As a result, she asked the court to issue a decree of divorce, terminating their 21-year-old marriage.

“The defendant has never bothered to explain to the plaintiff as to why he no longer renders to her conjugual rights,” further reads the wife’s particulars of claim.
Lubombo Principal Magistrate Dumisani Magagula granted the decree of divorce and further granted the wife custody of the three children.
The court further ordered that the husband must forfeit the matrimonial assets.
